Kip Hamilton

Biography

Kip Hamilton is a licensed Certified Public Accountant and Certified Fraud Examiner with over 35 years of experience assisting counsel and clients in the resolution of complex financial disputes. Kip has served as an expert witness, consultant and arbitrator in matters relating to economic damages, white collar criminal investigations, due diligence, internal investigations and forensic accounting.

In the general commercial disputes arena, Mr. Hamilton has experience investigating liability issues and evaluating damages for both plaintiffs and defendants in numerous industries including private education, manufacturing, consumer products, lodging, banking, advertising, legal, accounting, insurance, leisure, retail, wholesale, transportation, casino, broker/dealer and entertainment industries.

Mr. Hamilton also has specific experience in the real estate and construction industries where he has assisted owners, contractors, subcontractors, engineers, developers, lenders, sureties and governmental agencies resolve disputes. Kip has developed strategies, performed cost audits and evaluated damages arising from project delays, financing issues, bankruptcy, accidents, fraud and troubled projects.

Kip has worked on various international disputes including matters in Latin America and Asia. He has provided expert testimony on numerous occasions in federal and state courts, U.S. Bankruptcy Court, arbitration proceedings and State Board of Claims. Kip also serves on the American Arbitration Association Panel of Neutrals and has served as a solo arbitrator and as a panel member. Prior to joining GlassRatner (now doing business as B. Riley Advisory Services), Kip held senior positions with an international CPA firm, a worldwide risk mitigation firm and owned his own forensic accounting practice.

Representative assignments on which Mr. Hamilton has worked include:

  • Conducted due diligence of a specialty contractor related to a $240 million refinance.
  • Investigated allegations of bid rigging by a ship repair company on behalf of the DOJ.
  • Arbitrated a dispute between joint venture partners in a financial planning and investment firm.
  • Assisted a bank assess solvency, adequacy of capital and ability to pay issues in a loan avoidance action.
  • Testified on behalf of an owner who was indicted for fraud regarding funds received to operate private schools.
  • Arbitrated a dispute involving an earn out provision in an asset purchase agreement.
  • Assisted an investor prove the general contractor was improperly diverting funds to other projects.
  • Calculated damages in a breach of contract matter for a national print service company.
  • Assisted a carrier defend a claim for lost profits relating to an accident that delayed the construction and sale of condominium units.
  • Assisted a company that sells insurance products assess damages it incurred after a failed acquisition and the loss of key sales personnel.
  • Audited $12 million in change order costs submitted by several contractors on a multiple prime project to replace an elevated rail line and construct new stations.
